Draft for testing. This text has not been reviewed by a lawyer and is not legal advice. Anything in [BRACKETS] is a placeholder that must be filled in or decided before Zomli is used by real people.
Terms of Use
1. Who we are and what Zomli is
Zomli is an app that helps parents create stories for their children. You write a short description of the story you want and pick a level, and an AI writes the story while you watch. Zomli is provided by [COMPANY NAME], [ADDRESS], [COUNTRY] ("we", "us"). You can reach us at [CONTACT EMAIL].
By accepting these terms and using Zomli you agree to them. If you do not agree, please do not use Zomli.
2. Who can use Zomli
Zomli is for parents and other adults. You must be at least [18] years old, or the age of majority where you live, to create an account. Zomli is not meant to be used by children on their own; the stories are for you to read to or with a child.
You sign in with your email address and a one-time code that we send you. There is no password. Keep your email account safe: anyone who can read your emails can sign in as you. You are responsible for what happens under your account.
3. Stories are written by an AI
- Stories are generated by an AI model. They can be unexpected, inaccurate or not right for your child, even though we tell the AI to write for the age of the level you picked and to keep things gentle. Please read a story yourself before you share it with a child.
- The stories are not advice of any kind, and are not a substitute for professional help or your own judgement as a parent.
- Your description is sent to the AI to write the story. Please do not include full names, addresses, school names or other details that identify a child or another person. See our Privacy Policy.
4. What you may not do
You may not use Zomli to:
- create content that is unlawful, that sexualises or harms children, or that is hateful, violent or abusive;
- try to get around the safety rules of the AI, or to make it reveal its instructions;
- use scripts, bots or other automated means to use Zomli, or use it in a way that harms the service or other people's use of it;
- share your account, or sell or give access to Zomli to others;
- try to break into, test the security of, or copy any part of Zomli without our written permission.
5. Free stories, limits and Zomli Pro
- Each account can write [3] stories for free. After that you need Zomli Pro to write more.
- To protect the service from misuse, everyone can write at most [10] stories per day. We may change these numbers and will tell you if a change affects you.
- Zomli Pro is a subscription that you buy through the Apple App Store or Google Play. The price, the length of the subscription, free trial terms and automatic renewal are shown before you buy. Payment, renewal, cancellation and refunds are handled by Apple or Google under their rules, and you cancel in your store account settings.
- We check with our subscription provider, RevenueCat, whether your account has Zomli Pro. A change in your subscription can take up to an hour to show.
6. Your content
What you write to describe a story, and the stories written for you, are your content. You keep whatever rights you have in what you write. You give us the right to store and process your content only as needed to run Zomli for you: to write your stories, keep them in your library, and keep the service working and safe.
You may use the stories for personal, non-commercial purposes, for example to read to your family. [DECIDE: whether anything more, such as sharing or publishing, is allowed.] Because stories are written by an AI, we cannot promise that no one else will receive a similar story, or that you have exclusive rights to it.
7. Our rights
Zomli, including the app, its design, its name and its software, belongs to us or our licensors. These terms do not give you any right to them except the right to use Zomli as described here.
8. The service can change
We work to keep Zomli available, but we do not promise that it will always be available, error-free or unchanged. We may change, pause or stop parts of Zomli. Zomli is currently under development and may be reset or have its data removed.
9. Suspending or ending your use
You can stop using Zomli at any time. We may suspend or end your access if you break these terms or use Zomli in a way that puts the service or others at risk. To ask us to delete your account and the content in it, contact us at [CONTACT EMAIL]; see the Privacy Policy for what happens to your data.
10. Our responsibility
[REVIEW WITH A LAWYER.] We are responsible for harm we cause by our own fault, as the law requires. Beyond that, and as far as the law allows, Zomli is provided "as is", and we are not responsible for indirect or unforeseeable losses, or for how you or your child use a story. Nothing in these terms limits rights that you have as a consumer by law.
11. Changes to these terms
We may publish a new version of these terms. Each version has its own date, and the page you are reading is the version dated above. When there is a new version, Zomli will ask you to accept it before you can write more stories. If you do not accept it, you can stop using Zomli.
12. Governing law
These terms are governed by the laws of [COUNTRY]. [REVIEW: disputes, and the rights of consumers to use their local courts.]
